My son filed an RTI in the BMC office

The Builder R.C.Construction Company has first build a gallery and later in the year 2013 broke our gallery stating that it is not allowed by the BMC when we asked him to show the permission or order of the BMC he denied to show us any order or Permission given by the BMC. So i told my Son to file an RTI and get the Information.

My Son filed an RTI on 27th OCt 2014, the builder and his men came to know about the RTI through their men in the BMC offie. The Builder and his goons threatned my son with dire consequences if he again dares to visit the BMC office.

My name is Krishna J. Bahl. I am a Female Widow 72 Years of Age,  I am Diabetic as well as having high blood pressure Recently i had major operation for hernia in may 2012 since then i am undergoing treatment and spent a lot of money on my treatment. I was a Resident of C/5, Janta Nagar, Hall Road,Kurla west Mumbai 400070 Our Chawl was taken for Redevelopment by R.C.Construction Co. The Builder had paid Rs 1,80,000/- as 18 months advance Rent from 29th December 2008 to 28th June 2010. The Builder Promised that he would Redevelop our chawl into building in 18 months and incase of any delay in construction he would pay Rs 15000/- (Fifteen thousand only ) towards Alternate Rental Charges.

Through Registered Postal letter on 29th July 2010 I sent him a reminder that 18 months period has passed and the construction of the building is yet to be completed. So as per our agreement he should Pay Rs 15000/-(Fifteen thousand only ) towards Alternate Rental Charges. It is Clearly Stated in the Agreement (Clause 11 ) in Event of any Delay in Construction the Developer will be liable to pay the Amount of Rs 15000/- (Fifteen thousand only ) per month. The Builder paid Rent from July 2010 to may 2011 @ Rs 10,000/- (Ten thousand only ) per month. Rs 5000/- (Five Thousand Only )  Short of what he was supposed to pay.

The builder has not paid any rent since June 2011, I Called him Several times on his Telephone No. 022 25034064 and his Office Incharge Mr Chakravaty on his mobile No. 9224332063 and requested him to pay the rent for alternate accommodation but he always said that he will pay the rent in a few days but never paid. On 6th July 2012 I Sent him a Reminder through Registered Speed Post and demanded that he pay the rent for 14 months from June 2011 to July 2012 but there was no reply.

As per my calculations the Builder (R.C.Construction Co. ) has to pay me Rs 15000/- x 29 Months = 4,35,000/- (Four Lac Thirty Five Thousand Only ) and from July 2010 to May 2011 you have paid Rs 10,000/- as monthly rent so the remaining Rs 5000/- per month i.e. Rs 5000 x 12 Months = 60,000/- ( Sixty Thousand Only ) So the total amount you should pay me is Rs 2,70,000/- (Four Lac Ninety Five Thousand Only ) along with the Interest charges and the penalty amount for causing mental harassment

In March 2013 the builer Broke the gallery space around my flat saying that the BMC has changed their rule and told them to do so. At the time of Construction the Builder has taken 3 cheques of Rs 1,00,000/- each ( One Lac Rupees ) for giving extra 50 square foot and gallery space. He has not even provided us the alternate agreement. In June 2013 he has started the construction of the 8th floor which according to me may be illegal when i asked to show the permission he refuse to do so.

The consequence i had to face :

Take loan from my friends and relative for my medical treatment.

Delay in getting medical treatment due to lack of money.

People would give their house only for eleven months. After elven months i had to shift the house from one place to another which is time consuming as well as frustrating. I am not able to move furniture and other things from one house to another due to my age so i have to hire people by paying them money.

Pay One month Rent as Commission to the broker for getting a new house on rent after elven months

Furniture and electronic products got damaged while shifting the house.

I had to stay in rental apartment which has toilet outside and facing difficulty going to toilet because of my age.

Facing Financial problem due to builder not paying rent on time.

Mental stress due to builder always giving false date of possession of my house, when i call on the specific date the builder gives some excuse saying it will take more time.

what i want from the builder :

Copy of the Alternate Agreement for which he had taken 3 cheques of Rupees one lac

Rent for 29 months @ Rupees 15000 per Month along with the interest charges and compensation for mental harassment .

Possession of My house as soon as possible. and to provide me the exact date by when i will get the possession of my house.

show me the permission for breaking my gallery and construction of the 8th floor

R.C.Construction Company Office Staff Giving False assurance then denying to pay rent



Entire Description From 2008 to 2015 delay in construction


20th October 2008 : As per our talks with R.C.Construction Company for redevelopment of our Chawl Janta Nagar. R.C.Construction Company gave us a Cheque of Rs 1,80,000/- (One Lac Eighty Thousand Rupees)  towards Alternate Accommodation for the period of 18 months’ Rent @ Rs 10,000/- per month and requested us to find an alternate accommodation for ourselves.

As per our Agreement the R.C.Construction Company agreed to give us 400 Square Foot Carpet Area Plus he agreed to give us 50 Square Foot extra at Rupees 6000/- (six Thousand Only) per Square foot, for that R.C.Construction Company took 3 Cheques of Rupees 1,00,000/- (One Lac Only )  Each.  R.C.Construction Company has told us we have to clear the first cheque on construction of First Floor, Second Cheque on construction of Fifth Floor and the last cheque before he gives us the keys of my flat.

R.C.Construction Company said they have not included the 50 Square foot extra they are giving in the main agreement and they will give a Supplemental Agreement for the 50 Square Foot extra apart from the 400 Square Foot they will be giving.

29th July 2010 : I sent R.C.Construction Company a Reminder Notice demanding rent for Alternate Accomodation as per  R.C.Construction Company letter dated 28th December 2008. As 18 months had completed on 27th June 2010. 

30th july 2010 to 6th july 2012 : I had Called the Office of  R.C.Construction Company Several times only to Receive false assurances that the Building work is in progress and it will be completed soon.

07th July 2012 : I sent a Second Reminder Notice to R.C.Construction Company demanding Rent and Completing the Construction of Building a soon as possible as I had a major operation of Hernia and my last wish is to stay in my own house before my death but in Vein.

Year 2012 -2013 :  R.C.Construction Company Broke our Gallery and started the Construction of 8th and 9th Floor, I doubt that R.C.Construction Company broke our gallery and  used the FSI of our gallery for building 8th and 9th floor. When we asked for a reply R.C.Construction Company told us it broke our gallery as per order of the B.M.C. office. when we demanded a written permission or order they refused to show us. I assumed they were giving false information so i thought of filing an RTI against R.C.Construction Company.

28th October 2014 :  My son Shri Shyam Bahl filed a Request for RTI under the Right to Information Act 2005 for our Building which is under Redevelopment. But he could not get the information as the Builder and his goons threatened my son with dire consequences. The Builder even said that Kurla Police Station Officers are in his pocket and they won’t entertain any complaint related to R.C.Construction Company so I was afraid to file any complaint against R.C.Construction Company as I am old and I have a only one son and a daughter . I would like to mention R.C.Construction Company and their goons should be held responsible if anything happens to me, my son or any of my family members.
